Privacy Notice “Sánchez-Saldaña Abogados”

SANCHEZ SALDAÑA & GARCÍA SÁNCHEZ, S.C. (commercially known as “Sánchez-Saldaña Abogados”), located at Calle Río Nilo No. 88, 5th Floor, Offices 501/502, Cuauhtémoc Borough, Zip Code 06500, Mexico City, is a Mexican law firm specialized in litigation in civil, commercial, administrative and constitutional matters. It is the party responsible for and committed to respecting and protecting the rights related to personal data as recognized under Article 16, Section II, of the Political Constitution of the United Mexican States (“Personal Data”), as well as for their proper handling, control, and use, in order to guarantee the general public’s right to privacy and the right to informational self-determination, pursuant to the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (“LFPDPPP”) and its Regulations.

By accessing and using the website whose domain name is: https://ssya.mx (the “Site”), owned by Sánchez-Saldaña Abogados, you (the “Data Subject”) acknowledge that this Privacy Notice has been made available to you and you express your acceptance of the terms and conditions contained herein by not expressing opposition to them. You also give your express consent to the processing of your Personal Data solely for the purposes outlined on said portal.

 

The Data Subject, whether as a visitor to the Site, to our offices, or as a client, accepts and acknowledges that Sánchez-Saldaña Abogados will obtain, by lawful means, their non-sensitive personal data, such as email address, country, state, and city or district of residence and/or of the organization’s operation, and grants consent under the terms of the LFPDPPP and its Regulations for Sánchez-Saldaña Abogados to process such data for the purposes set out in this Privacy Notice.

 

Sánchez-Saldaña Abogados may obtain personal data of the Data Subject from publicly accessible sources, solely for the purpose of validating, updating, and contacting the Data Subject, always respecting their reasonable expectation of privacy pursuant to Article 7 of the LFPDPPP.

 

This Privacy Notice is made available to the Data Subject prior to the processing of their Personal Data, in order for them to be informed of how their data is collected, used, stored, and processed by the Firm. Its purpose is to inform the Data Subject about their rights and the means to exercise them if they believe that their Personal Data has been misused, misstored, or mishandled.

 

Sánchez-Saldaña Abogados may use IP (Internet Protocol) information to analyze any type of threat to the Site, as well as to collect demographic data and improve content, without using such information to identify Data Subjects—except where unlawful, fraudulent, or legally non-compliant behavior is suspected.

 

In compliance with Articles 12 to 17 and related provisions of the LFPDPPP, visitors to the Site are hereby informed that the Personal Data collected will be processed lawfully and in accordance with the provisions of the law.

The following Personal Data may be collected by Sánchez-Saldaña Abogados from the Data Subject, as a visitor to the Site or to the offices mentioned above:

  1. Full name;
  2. Billing information;
  3. Official identification;
  4. Professional data, where applicable;
  5. Image data captured by our CCTV system;
  6. Company and position held.

We do not collect or process sensitive Personal Data.

In strict compliance with Article 16 of the LFPDPPP, Sánchez-Saldaña Abogados accepts and acknowledges that it will process the Personal Data of the Site’s visitors exclusively for the following primary purposes:

  1. To establish contact with the Data Subject for the provision of specialized legal services in civil, commercial, administrative, or constitutional matters;
  2. To create physical and/or digital case files for the analysis, follow-up, and legal handling of matters under consultation, advice, or legal representation;
  3. To validate and verify the authenticity of the information provided by the Data Subject and to periodically update it when necessary for the proper delivery of services;
  4. To manage the legal relationship with the client, including preparatory acts, follow-up, or historical archiving;
  5. To procure or provide products or services;
  6. To comply with obligations contracted with the Data Subject regarding said products or services;
  7. To formalize the provision of professional services or the procurement of a product or service in contracts or other legal documents; and
  8. To process related billing.

Sánchez-Saldaña Abogados may process the Personal Data of Site visitors for the following secondary purposes:

  1. To assess the quality of legal services provided by Sánchez-Saldaña Abogados, including conducting client satisfaction surveys and obtaining feedback;
  2. To gather comments and suggestions about the content, design, navigation, and accessibility of the website https://ssya.mx;
  3. To inform the Data Subject of legal developments, legislative changes, newsletters, publications, or legal analysis articles prepared by Sánchez-Saldaña Abogados;
  4. To send invitations to events, courses, seminars, or activities organized, conducted, or sponsored by Sánchez-Saldaña Abogados.

The Data Subject may exercise their ARCO rights (access, rectification, cancellation, and opposition), as well as revoke their consent to the processing of their Personal Data, at any time, by submitting a written request to the following email address: admin@ssya.mx The request must include, at a minimum:

  1. Full name of the Data Subject and a means of communication for the response;
  2. A clear description of the data for which the Data Subject wishes to exercise their rights;
  3. Documentation proving the identity of the Data Subject or their legal representation, as applicable.

The response will be issued by Sánchez-Saldaña Abogados within the legal timeframe and in accordance with the provisions of the LFPDPPP.

If the Site visitor does not wish their Personal Data to be used for any or all of the above-mentioned secondary purposes, they must submit a request for data deletion, specifying the purposes for which they do not wish their Personal Data to be processed, to the email address: admin@ssya.mx

Sánchez-Saldaña Abogados will confirm the deletion of the Data Subject’s Personal Data via the same email once the blocking period has concluded.

Sánchez-Saldaña Abogados commits to observing, with respect to the Personal Data collected from visitors to the Site and its offices, the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and accountability, in strict compliance with the LFPDPPP and its Regulations.
